**General Terms and Conditions (GTC)**
**1. Scope**
These General Terms and Conditions (GTC) apply to all contracts concluded between Umberto Felipe Styleworks GmbH and its customers. Deviating conditions of the customer are not recognized unless Umberto Felipe Styleworks GmbH expressly agrees to their validity in writing.
**2. Conclusion of Contract**
The contract is concluded when the customer submits the order and it is accepted by Umberto Felipe Styleworks GmbH. Acceptance is confirmed either by an explicit confirmation via email or by the delivery of the ordered goods.
**3. Prices and Payment Terms**
All prices are in euros, including the statutory value-added tax. Additional delivery and shipping costs will be charged separately and shown during the ordering process. Payment can be made by advance payment, credit card, or PayPal. The purchase price is due immediately unless otherwise agreed.
**4. Delivery**
Delivery is made to the address specified by the customer. Delivery times are non-binding unless a delivery date has been expressly confirmed. If Umberto Felipe Styleworks GmbH is unable to deliver the ordered goods through no fault of its own because a supplier does not fulfill their contractual obligations, Umberto Felipe Styleworks GmbH is entitled to withdraw from the contract. In this case, the customer will be informed immediately, and any payments made will be refunded.
**5. Right of Withdrawal**
Consumers have the right to withdraw from the contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the customer or a third party named by them has taken possession of the goods. To exercise the right of withdrawal, the customer must inform Umberto Felipe Styleworks GmbH of their decision to withdraw from the contract by means of a clear declaration (e.g., a letter sent by post or email).
**6. Retention of Title**
The goods remain the property of Umberto Felipe Styleworks GmbH until full payment has been made. In the event of default in payment, Umberto Felipe Styleworks GmbH is entitled to withdraw from the contract and reclaim the goods.
**7. Warranty**
The statutory warranty provisions apply. If the delivered goods are defective, the customer must notify Umberto Felipe Styleworks GmbH immediately. Umberto Felipe Styleworks GmbH is entitled to remedy the defect at its own discretion either by repair or replacement.
**8. Liability**
Umberto Felipe Styleworks GmbH is fully liable for intent and gross negligence. In cases of simple negligence, Umberto Felipe Styleworks GmbH is only liable for damages resulting from injury to life, body, or health, as well as for damages resulting from the breach of an essential contractual obligation (cardinal obligation). In these cases, liability is limited to foreseeable damages typical for such contracts.
**9. Data Protection**
Information on the processing of customers' personal data is contained in the privacy policy, which is available on the Umberto Felipe Styleworks GmbH website.
**10. Final Provisions**
The law of the Republic of Austria shall apply, excluding the UN Sales Convention. If the customer is a merchant, the place of jurisdiction for all disputes arising from contractual relationships between the customer and Umberto Felipe Styleworks GmbH is the registered office of the company.
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
